Terms of Service

Please read these Terms of Service ("Terms") carefully before using Symmra (the "Service"), a service operated by Simply Modern Designs LLC. By creating an account, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Symmra. By using the Service, you represent that you meet this requirement and that all information you provide is accurate.

2. Not Medical Advice

Symmra, including our AI coaching feature ("Simmi"), does not provide medical, nutritional, or health advice. All workout programs, nutrition targets, and coaching recommendations generated by the Service are for general informational and fitness purposes only.

You should consult a physician or other qualified health provider before beginning any exercise or nutrition program, especially if you have any pre-existing health conditions, injuries, or concerns. You assume full responsibility for evaluating whether any recommendation from the Service is appropriate for you, and you agree to stop any activity that causes pain, discomfort, or that a healthcare provider has advised against.

Simmi's photo-based check-in feature provides general visual observations for coaching purposes only. It does not diagnose, measure body fat percentage with medical accuracy, or replace professional medical or fitness assessment.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. You may only maintain one account per person.

4. Subscriptions and Billing

Symmra offers subscription tiers ("Train" and "Coach"), billed monthly or annually as selected at signup. By subscribing, you authorize us (via our payment processor, Stripe) to charge your payment method on a recurring basis until you cancel.

Free trials: Certain plans include a free trial period. If you do not cancel before the trial ends, your payment method will be automatically charged for the subscription.

Founding member pricing: Certain founding pricing tiers are offered to a limited number of early subscribers and are locked in for as long as your subscription remains active and uninterrupted, subject to the terms presented at signup.

Cancellation: You may cancel your subscription at any time through your account settings or our billing portal. Cancellation takes effect at the end of your current billing period; we do not provide prorated refunds for partial billing periods except as required by law.

Price changes: We may change subscription prices with advance notice. Price changes will not apply to your then-current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
  • Interfere with or disrupt the Service, including through excessive automated requests
  • Reverse engineer, scrape, or misuse any part of the Service or its underlying data
  • Impersonate any person or misrepresent your affiliation with any person or entity
  • Upload content that is unlawful, harassing, or infringes on others' rights

We reserve the right to suspend or terminate accounts that violate these Terms.

6. User Content

You retain ownership of the content you submit (such as progress photos, custom recipes, and food entries). By submitting content marked as shared or community content, you grant us a license to display that content to other users within the Service, even if you later delete your account, except where you have exclusive ownership rights that require otherwise.

7. Intellectual Property

The Service, including its software, design, and content (excluding your own submitted content), is owned by Symmra and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RECOMMENDATIONS GENERATED BY THE SERVICE WILL ACHIEVE ANY PARTICULAR RESULT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMMRA AND ITS FOUNDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, LOSS OF DATA, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms. You may terminate your account at any time by deleting it in Settings. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Dallas, Texas.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
